PRIMO PIANO 14 PRIMO PIANO It should be noted, in fact, that the European Commission has expressly prohibited triangulations with the countries of the Eurasian Economic Union in order to bypass the bans imposed by the European Union on Russia and Belarus. In its notice to economic operators issued on April 1, 2022, the EU Commission urged operators to pay the utmost attention to sanctions, including through triangulations with the countries of the Eurasian Economic Union and, in particular, with Armenia, Kazakhstan and Kyrgyzstan. In order to avoid sanctions application, it is advisable for economic operators to insert in every import/export contract specific clauses to ensure that goods are not subject to restriction. Exporting companies will be able to make a declaration stating that compliance with the rules on sanctions is an essential element of the contract (under penalty of nullity), also undertaking not to export to Russia and Belarus. It should be noted that in Italy, the Parliamentary Committee for the Security of the Republic seems to have already started the first investigations aimed at monitoring possible triangulations. Therefore, it is essential for companies and operators working in international trade to pay particular attention to export control and carry out prior due diligence of products and their destinations to avoid incurring the application of important sanctions. In fact, in case of non-compliance with the trade restrictions imposed by the EU, the discipline contained in Articles 18 and 20 of Legislative Decree 221/2017 is applied. This provides fines from 15 thousand to 250 thousand euros and a prison sentence from two to six years. Specifically, different penalties are envisaged depending on whether the infringed legislation relates to the transmission of dual-use technologies or bans on exporting other products subject to restrictive measures. For the violation of dual-use regulations, a prison sentence of two to six years or a fine of 25 thousand to 250 thousand euros is provided for anyone who transmits products and technologies abroad in the absence of the necessary Uama (Unit for the Authorization of Armament Materials) authorizations or using an authorization issued based on false documentation (Article 18, paragraph 1, Legislative Decree 221/2017). The violation of the indications provided by the individual Uama authorizations is, instead, punished with imprisonment from one to four years or a fine from 15 thousand to 150 thousand euros (art. 18, paragraph 2, Legislative Decree 221/2017). On the other hand, the transmission of almost dual-use goods without the required Uama authorizations is sanctioned with imprisonment from two to six years or a fine from 25 thousand euros to 250 thousand euros (art. 20, paragraph 2, legislative decree 221/2017). For the export of products subject to EU restrictive measures, for which there is no specific authorization, the penalty is imprisonment from two to six years (art. 20, paragraph 1, legislative decree 221/2017). The violation of the requirements to take advantage of any exemptions is, instead, punished with imprisonment from one to four years or a fine from 15 thousand to 150 thousand euros (art. 20, paragraph 3, Legislative Decree 221/2017). Finally, it should also be noted that imports from Russia have also been affected by import bans and restrictive measures. Per evitare di incorrere nell’applicazione delle sanzioni, è consigliabile, per gli operatori economici, inserire in ogni contratto di import/export specifiche clausole, volte a garantire che le merci non sono soggette a restrizione. Le imprese esportatrici potranno effettuare una dichiarazione in cui affermano che il rispetto delle regole sulle sanzioni è un elemento essenziale del contratto (a pena di nullità), impegnandosi anche a non esportare verso Russia e Bielorussia. Da segnalare che in Italia, il Comitato parlamentare per la sicurezza della Repubblica sembra aver già avviato le prime indagini volte a monitorare eventuali triangolazioni. È pertanto indispensabile, per le imprese e per gli operatori che operano nel commercio internazionale, prestare particolare attenzione all’export control ed effettuare una due diligence preventiva dei prodotti e delle loro destinazioni, per evitare di incorrere nell’applicazione di rilevanti sanzioni. In caso di mancata osservanza delle restrizioni commerciali disposte dall’UE, infatti, trova applicazione la disciplina contenuta negli artt. 18 e 20 del d.lgs. 221/2017, che prevede multe da 15 mila a 250 mila euro e una pena detentiva da due a sei anni. In particolare, sono previste pene diverse a seconda che la normativa violata sia relativa alla trasmissione di tecnologie dual use oppure ai divieti di esportazione degli altri prodotti, destinatari di misure restrittive. Per la violazione della normativa dual use è prevista la pena detentiva dai due a sei anni o la multa da 25 mila a 250 mila euro, per chiunque trasmette all’estero prodotti e tecnologie in assenza delle necessarie autorizzazioni Uama (Unità per le autorizzazioni dei materiali d’armamento) o utilizzando un’autorizzazione rilasciata sulla base di documentazione falsa (ar t. 18, comma 1, d.lgs. 221/2017). La violazione delle indicazioni previste dalle singole autorizzazioni Uama è, invece, punita con la reclusione da uno a quattro anni o con la multa da 15 mila a 150 mila euro (art. 18, comma 2, d.lgs. 221/2017). La trasmissione dei beni quasi dual use, in assenza delle autorizzazioni Uama richieste, è invece sanzionata con la detenzione da due a sei anni o con la multa da 25 mila euro a 250 mila euro (art. 20, comma 2, d.lgs. 221/2017). Per l’esportazione di prodotti oggetto di misure restrittive UE, per le quali non è prevista una specifica autorizzazione, la pena è la reclusione da due a sei anni (art. 20, comma 1, dlgs 221/2017). La violazione delle prescrizioni per fruire di eventuali deroghe è, invece, punita con la detenzione da uno a quattro anni o la multa da 15 mila a 150 mila euro (ar t. 20, comma 3, d.lgs. 221/2017). Da segnalare, infine, che anche le importazioni dalla Russia sono state colpite da divieti e misure restrittive. Il blocco alle importazioni riguarda numerosi prodotti siderurgici in ferro e alluminio provenienti dalla Russia, così come i materiali energetici e il carbone, ma anche diversi beni utilizzati dai consumatori e dalle imprese unionali, come crostacei, caviale, pneumatici, legno calcestruzzo e numerosi concimi (Reg.
